1. Acceptance of Terms

SK North Carolina Constructions provides construction, remodeling, renovation, and related services to residential and commercial clients in North Carolina and surrounding areas. Our services include, but are not limited to: kitchen remodeling, bathroom remodeling, flooring installation, countertop replacement, cabinet refinishing, patio remodeling, landscaping, door installation, home remodeling, house painting, window replacement, shower remodeling, room additions, and general construction services.
All services described on this Website are subject to availability, geographic limitations, and the Company’s discretion. The inclusion of any service on this Website does not constitute a guarantee that such service will be available at any given time or location. Service offerings, pricing, and availability may change without notice.
4. Estimates, Quotes & Pricing
All estimates and quotes provided by SK North Carolina Constructions are non-binding approximations based on the information available at the time of assessment. Estimates are subject to change based on unforeseen conditions discovered during the course of work, including but not limited to: hidden structural damage, code compliance requirements, material price fluctuations, supply chain delays, changes in scope requested by the Client, and any conditions that could not have been reasonably foreseen at the time of the initial estimate.
Final pricing will be outlined in a separate written contract or agreement prior to the commencement of work. No work will begin until a signed agreement and any required deposits have been received. The Company reserves the right to adjust pricing if the scope of work changes, materials costs increase significantly, or additional work is required beyond the original scope.
Any promotional pricing, discounts, or special offers displayed on the Website are subject to terms, conditions, and expiration dates specified at the time of the offer. The Company reserves the right to withdraw or modify any promotion at any time without prior notice.
5. Project Agreements & Contracts
All construction and remodeling projects undertaken by SK North Carolina Constructions are governed by a separate written project agreement or contract executed between the Company and the Client prior to commencement of work. These Terms and Conditions are supplementary to and do not replace any such project-specific agreements.
In the event of a conflict between these Terms and a project-specific agreement, the project-specific agreement shall prevail with respect to the services covered therein. For all other matters, these Terms shall govern.
Project agreements will specify the scope of work, payment schedule, project timeline, change order procedures, warranty terms, and any other terms specific to the project. The Client is responsible for reading and understanding the project agreement in its entirety before signing.
6. Payment Terms
Payment terms, schedules, and methods will be specified in the project agreement. Unless otherwise stated in writing, the following general payment terms apply:
A deposit may be required prior to the commencement of any work. The deposit amount will be specified in the project agreement. Progress payments may be required at various stages of the project as outlined in the project agreement. Final payment is due upon completion of the project and prior to final walkthrough or handover.
Late payments may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by North Carolina law, whichever is less. The Client is responsible for all costs of collection, including but not limited to attorney’s fees, court costs, and collection agency fees, in the event that the Company must take legal action to collect unpaid amounts.
The Company reserves the right to suspend or terminate work on any project for which payment is past due, and to file a mechanic’s lien on the property.
7. Change Orders
Any changes to the original scope of work, materials, design, or specifications after the project agreement has been signed must be documented in a written change order signed by both the Company and the Client. Change orders may result in adjustments to the project cost, timeline, or both.
Verbal requests for changes will not be considered authorized change orders. The Company is not responsible for performing work outside the agreed-upon scope without a properly executed change order. Work performed pursuant to a verbal request without a signed change order may be billed at the Company’s standard rates.
8. Warranties & Guarantees
SK North Carolina Constructions stands behind the quality of our workmanship. Specific warranty terms will be outlined in the project agreement for each project. Unless otherwise specified, the Company provides a limited workmanship warranty for a period specified in the individual project agreement from the date of project completion.
This warranty covers defects in workmanship only and does not cover: normal wear and tear; damage caused by the Client, third parties, or acts of nature; damage caused by improper maintenance or use; materials that carry their own manufacturer warranty; issues arising from pre-existing conditions not disclosed to the Company; or any modifications made to the completed work by parties other than SK North Carolina Constructions.
The Company makes no warranties, express or implied, beyond those explicitly stated in the project agreement. All implied warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.
Manufacturer warranties on materials and products are passed through to the Client and are subject to the manufacturer’s terms and conditions. The Company is not responsible for enforcing or honoring manufacturer warranties.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SK NORTH CAROLINA CONSTRUCTIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE WEBSITE OR SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) ANY CONTENT OBTAINED FROM THE WEBSITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL THE COMPANY’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE WEBSITE EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
For claims arising from construction or remodeling services, the Company’s total liability shall not exceed the total contract price for the specific project giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, strict liability, or otherwise.
10. Indemnification
You agree to indemnify, defend, and hold harmless SK North Carolina Constructions, its officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, and affiliates from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorney’s fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Website or services; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any claim that your use of the Website or services caused damage to a third party; (e) any misrepresentation made by you; or (f) your breach of any applicable laws or regulations.
11. Website Use & Intellectual Property
All content, materials, and features available on this Website, including but not limited to text, graphics, logos, images, photographs, videos, audio clips, digital downloads, data compilations, and software, are the property of SK North Carolina Constructions or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

The Client is responsible for reviewing and understanding the financing agreement in its entirety before accepting.
SK North Carolina Constructions shall not be liable for any disputes between the Client and the third-party lender, including but not limited to disputes regarding interest rates, payments, fees, or credit reporting.
20. Insurance & Licensing
SK North Carolina Constructions maintains appropriate insurance coverage, including general liability insurance and workers’ compensation insurance, as required by North Carolina law. Proof of insurance is available upon request.
The Company is a licensed general contractor in the State of North Carolina. All work is performed in compliance with applicable building codes, permits, and regulations. The Client is responsible for obtaining any permits required for work performed on their property, unless otherwise agreed upon in the project agreement.
21. Dispute Resolution
21.1 Informal Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any services provided by SK North Carolina Constructions, the parties agree to first attempt to resolve the matter through good-faith informal negotiation. The party raising the dispute shall provide written notice to the other party describing the nature of the dispute and the relief sought. The parties shall have thirty (30) days from the date of such notice to attempt to resolve the dispute informally.
21.2 Mediation
If the dispute cannot be resolved through informal negotiation within thirty (30) days, the parties agree to submit the dispute to non-binding mediation administered by a mutually agreed-upon mediator in North Carolina before pursuing arbitration or litigation. The costs of mediation shall be shared equally by the parties.
21.3 Binding Arbitration
If the dispute cannot be resolved through mediation, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in North Carolina. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
21.4 Class Action Waiver
YOU AND SK NORTH CAROLINA CONSTRUCTIONS AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
21.5 Small Claims Exception
Notwithstanding the above, either party may seek relief in small claims court for disputes within the court’s jurisdiction, provided the matter remains in small claims court and advances only on an individual basis.
22. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding not subject to arbitration under these Terms shall be brought exclusively in the state or federal courts and you consent to the personal jurisdiction of such courts.
23. Force Majeure
SK North Carolina Constructions shall not be liable for any failure or delay in performing its obligations under these Terms or any project agreement where such failure or delay results from circumstances beyond the Company’s reasonable control, including but not limited to: natural disasters, pandemics, epidemics, government actions or restrictions, labor disputes or shortages, supply chain disruptions, material shortages or price increases, utility failures, acts of terrorism, war, civil unrest, fire, flood, earthquake, severe weather conditions, or any other event beyond the Company’s reasonable control.
In the event of a force majeure event, the Company shall notify the Client as soon as reasonably practicable and shall use reasonable efforts to mitigate the effects of the event. Project timelines and deadlines shall be extended by a period equal to the duration of the force majeure event.
24. Privacy & Data Collection
SK North Carolina Constructions collects, uses, and protects personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our Website or providing personal information to us, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

Any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
31. Assignment
